Small Balance Dispute
We’re careful not to ever promise you that we will collect your money. What we promise you is that we will give it our best efforts. If we cannot collect the money for you, we will tell you why and, perhaps, be able to offer some alternative options for you.
When an unpaid account is disputed, we try to get the full story from the debtor’s perspective, evaluate it, and then pass this information on to you. We work to negotiate settlements, clarify situations (when possible) with inexperienced debtors, and do everything that we can legally do to collect your money. Please remember: No money for you means no money for us!!
However, if a debtor adamantly insists that they feel their company has been wronged by your company, there may be little that we can do for you. We try to get a debtor to put their dispute in writing, so that you can respond to each issue. Sometimes, whether we like it or not, they may have some strength to their position. If the balance is over $1500.00, we may recommend sending the account to an attorney. HOWEVER, if the case is so highly disputed that you are at risk of a countersuit, we do not normally recommend legal action. If your debtor files a countersuit, you would then be required to pay the attorney to defend you on an hourly basis. This may run as much as $150.00 an hour.
For all of these reasons, we stress to you how extremely “vulnerable” you are to nonpayment especially with balances under $1500.00. We recommend that you monitor these accounts closely and place them with Rand Associates as soon as you have lost communication with your customer.
If you just cannot negotiate on a disputed balance, there may be little that we can do for you. We try to come to a settlement that can satisfy both you and your customer so that your business relationship is not jeopardized or compromised.
